1. Acceptance of Terms
By accessing FloorKey's platform at getfloorkey.com or completing a booking, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not make a booking.
These Terms constitute a legally binding agreement between you ("Guest") and FloorKey ("we," "us," or "our") governing your access to and use of office space booked through our platform.
If you are booking on behalf of a company or organization, you represent and warrant that you have authority to bind that entity to these Terms.
2. Bookings & Payments
All bookings are subject to availability and confirmation. A booking is not confirmed until you receive a written confirmation from FloorKey.
- Payment: Full payment for the rental period (including the 10% service fee) is charged at the time of booking via our secure payment processor (Stripe).
- Pricing: Prices are displayed per square foot per day and are subject to change until a booking is confirmed.
- Service Fee: A 10% platform service fee is added to the base rental rate. This covers booking management, support, and platform maintenance.
- Taxes: Applicable taxes may be added depending on the jurisdiction. Tax amounts, if any, will be shown at checkout.
By completing a booking, you authorize FloorKey to charge the payment method on file for all amounts due, including the rental fee, service fee, and any damage charges incurred during your stay.
3. Damage Deposit Hold
🔒 A $250.00 refundable damage deposit hold will be placed on your payment card as a security measure for each confirmed booking. This is an authorization hold only — your card is not charged. The hold is automatically released if no damage claim is filed.
By confirming a booking, you expressly authorize FloorKey to place a $250 authorization hold on your payment card. This hold is separate from your rental payment and works as follows:
- Hold amount: $250.00 USD per booking.
- When placed: The hold is placed after your booking payment is successfully processed.
- Not a charge: This is an authorization hold, not a charge. The funds remain available in your account but temporarily reserved.
- Automatic release: The hold is automatically cancelled and released 48 hours after your checkout date, provided no damage claim has been filed.
- Damage claims: If damage to the space or property is reported, FloorKey reserves the right to capture (charge) all or part of the $250 hold to cover documented repair costs. We will notify you before capturing any amount.
- Capture timeline: Any capture of the hold must occur within 7 days of your checkout date. After 7 days, the hold is released regardless.
Disputing or blocking the deposit authorization hold may result in cancellation of your booking and forfeiture of the rental payment.
4. Cancellation Policy
📅 Free cancellation: Cancel at least 48 hours before your check-in date for a full refund of the rental fee and service fee. The deposit hold will also be released.
- 48+ hours before check-in: Full refund of rental payment and service fee. No penalty.
- Less than 48 hours before check-in: No refund. The full rental payment and service fee are non-refundable.
- No-show: If you do not arrive and have not cancelled, no refund will be issued.
- Early checkout: Early departure does not entitle you to a partial refund unless separately agreed in writing.
To cancel, email floorkey@polsia.app with your confirmation number. Refunds are processed within 5–10 business days to the original payment method.
5. Permitted Use & Prohibited Conduct
Office spaces booked through FloorKey may be used for lawful professional business activities only, including meetings, focused work, team collaboration, and events permitted by the building.
The following are strictly prohibited:
- Subletting, re-renting, or granting access to the space to any third party not included in your booking.
- Using the space for any illegal activity, including activities that violate local, state, or federal law.
- Conducting any activity that violates the building's rules and regulations.
- Bringing pets, animals, or hazardous materials onto the premises unless explicitly approved.
- Smoking, vaping, or consuming alcohol in areas where it is prohibited by the building.
- Removing, damaging, or altering any furniture, fixtures, or equipment in the space.
- Exceeding the maximum occupancy stated on your booking.
- Using the space for residential purposes or overnight stays.
- Any activity that disturbs other tenants of the building.
⚠️ Violation of the permitted use terms may result in immediate termination of your booking without refund and may result in charges for any resulting costs or damages.
6. Damage Liability
You are responsible for leaving the space in the same condition in which it was provided to you. This includes furniture, equipment, walls, floors, and any other property within the space.
- Reporting damage: Any pre-existing damage should be reported to FloorKey within 1 hour of your check-in. Failure to report may result in you being held responsible for such damage.
- Repair costs: If damage occurs during your booking, you agree to pay for all reasonable costs of repair or replacement, as documented by FloorKey and/or the building owner.
- Deposit capture: FloorKey may capture your $250 deposit to cover documented damage costs. If costs exceed $250, you remain liable for the additional amount.
- Cleaning fees: If the space is left in an unreasonably unclean state (beyond normal use), a cleaning fee may be assessed and charged separately.
FloorKey will provide photographic evidence of any damage before initiating a charge and will give you an opportunity to respond within 48 hours of notification.
7. Limitation of Liability
To the fullest extent permitted by applicable law:
- FloorKey is a marketplace platform and is not responsible for the condition, safety, or suitability of any third-party office space.
- FloorKey's total liability for any claim arising from a booking shall not exceed the total rental amount paid for that specific booking.
- FloorKey is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity.
- FloorKey does not guarantee uninterrupted access to booked spaces and is not liable for service interruptions caused by building management, utilities, or force majeure events.
You use the spaces and the platform at your own risk. FloorKey strongly recommends obtaining appropriate business insurance for your company's activities.
8. Privacy & Data
We collect and process your personal information (name, email, company, and payment details) solely to facilitate your booking and communicate with you about your reservation.
- Payment data is processed securely by Stripe and is never stored on FloorKey's servers.
- We do not sell your personal information to third parties.
- We may send you transactional emails (booking confirmation, reminders) and, with your consent, marketing communications about new spaces.
- You may request deletion of your personal data by emailing floorkey@polsia.app.
9. Changes to Terms
FloorKey reserves the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by email.
Your continued use of the platform after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the platform and cancel any upcoming bookings.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Austin, Texas.
